Terms of Use

1. Acceptance of terms and service provider

By creating an account, downloading, or using the Samely mobile application, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, do not access or use our Services.

The Services are operated by ZEENII STUDIO (Individual Developer / Independent Studio), registered at Online service operated by ZEENII STUDIO, Hanoi, Vietnam, tax / business identification: N/A (Individual Developer).

If the English and Vietnamese versions differ, the English version prevails.

2. Eligibility criteria

To use Samely, you must satisfy the following conditions:

• Age requirement: You must be at least 18 years old.
• One account: You may register and operate only one personal account tied to your authentic Google credentials.
• Accurate information: You must provide truthful profile information and must not impersonate other individuals.
• Legal capacity: You must have full legal capacity to enter into a binding agreement under applicable law.

3. Account and security responsibilities

You sign in using your Google account credentials. You are responsible for maintaining the confidentiality of your device and authentication credentials.

All activities conducted under your Account are your responsibility. If you suspect unauthorized access to your account, inform our support team immediately.

4. How the service works and technical limitations

Samely enables physical proximity discovery over short-range Bluetooth waves. You acknowledge and understand that:

• Nearby detection depends on device hardware, battery levels, operating system versions, and physical surroundings (walls, glass, obstacles).
• There is no guarantee that every person physically nearby will appear in the app at any given moment.
• There is no matching algorithm and no compatibility score. Connections are formed solely through mutual choice.

5. Friend connections, messaging, and groups

Communication on Samely is governed by principles of mutual agreement:

• Mutual consent: Friend requests can be sent from Home profile cards, detail screens, or Area. Chat opens only after both individuals accept the connection.
• Group chats: Group conversations are led by a group leader with administrative privileges. Group members must adhere to respectful interaction rules.
• Blocking: You may block any user at any time. When blocked, two users cannot see each other on nearby cards and cannot message each other.

6. Your content and license

Regarding posts, photos, and messages you submit through the app:

• Ownership retained: You retain all intellectual property rights in the content you create and publish.
• Limited license: You grant Samely a non-exclusive, worldwide, royalty-free license solely to host, store, display, and transmit your content as necessary to operate the Services. This license ends when you delete your content or account.
• Third-party rights: You must not publish photos of other people without their verifiable permission.

7. Community standards and code of conduct

All users must maintain a safe, respectful environment. Prohibited conduct is detailed in our Community Standards and Child Safety document, which forms an integral part of these Terms.

8. Moderation, reporting, and enforcement

To protect community safety:

• Moderation: Profile pictures and public feed updates are subject to automated and human review for harmful content.
• In-app reporting: Any user can report abusive content or profiles. Reporting is confidential.
• Enforcement actions: Depending on severity, we may remove content, issue warnings, temporarily suspend features, or permanently terminate accounts.
• Appeals: If you believe an enforcement action was taken in error, you may email an appeal to contact@samely.app.

9. Points, ranks, and reward items

The Rewards feature operates under straightforward rules:

• No monetary value: Points and ranks have no cash value and cannot be redeemed for legal currency, sold, or transferred.
• App rules govern: Detailed rank criteria, milestone rewards, and monthly rank drops are displayed within the app and may change with advance notice.
• Fraudulent points: Points acquired through exploits, GPS spoofing, or automated bots will be revoked without notice.
• Gift redemptions: Physical gifts and vouchers are fulfilled manually and depend on available inventory.
• Partner offers: Third-party promotional offers are subject to the terms established by the relevant partner.
• Daily scratch card: The daily scratch card is a free feature requiring no purchase.

10. Paid features (VIP)

We may offer optional premium VIP features:

• Billing platform: All VIP purchases are processed through Google Play Billing. We do not process or store credit card details.
• Subscriptions and cancellation: If VIP is purchased as a recurring subscription, subscription management and cancellations must be carried out within Google Play Subscriptions.
• Refund policy: Refunds are handled according to Google Play refund policies and applicable statutory consumer laws.

11. Intellectual property rights

All brand logos, user interface designs, software code, visual artwork, and documentation belonging to Samely are the intellectual property of ZEENII STUDIO or its licensors.

You may not copy, reverse-engineer, decompile, or distribute any part of the application without prior written permission.

12. Service modifications and availability

We regularly update our service to improve functionality, fix bugs, and enhance performance. We may modify or temporarily suspend features for scheduled maintenance with advance notice where feasible.

13. Limitation of liability

To the maximum extent permitted by applicable law:

• Samely provides a digital discovery platform. Deciding to interact, share information, or meet another individual in person is an independent personal choice made at your own discretion.
• We are not responsible for user conduct taking place offline or outside the digital application.
• Nothing in these terms limits or excludes our liability for gross negligence, willful misconduct, or any statutory consumer warranty that cannot be disclaimed under applicable law.

14. Account termination

You may discontinue your use of the Services and delete your account at any time as explained on our Account Deletion page.

We may suspend or terminate your account if you breach these terms, violate community standards, or engage in abusive or unlawful behavior.

15. Amendments to these terms

We may revise these Terms of Use when operational or legal needs require. We will notify you in the app at least 7 days before any material amendment takes effect, unless changes are required sooner by law or for security reasons.

If you continue using the app after changes become effective, you accept the revised terms. If you disagree, you may delete your account.

16. Governing law and dispute resolution

These terms are governed by the laws of Laws of the Socialist Republic of Vietnam (without prejudice to mandatory local consumer protection and data protection rights under EU GDPR / UK GDPR / CCPA for global users), without depriving you of the mandatory consumer protections of the country where you live.

If a dispute arises, contact us first at contact@samely.app so we can attempt to resolve it informally in good faith. If informal discussions do not resolve the dispute within 30 days, the dispute will be resolved by the competent courts as the law provides.

These terms contain no mandatory arbitration requirement and no class-action waiver.
